1. Introduction and Acceptance

Welcome to One Night Stand India ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the website onenightstandindia.com, including any related mobile applications, features, content, and services (collectively, the "Platform").

By accessing, browsing, registering an account, or otherwise using the Platform in any manner, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and One Night Stand India. You should read them carefully and retain a copy for your records. We also recommend reviewing our Privacy Policy, which explains how we collect, use, and protect your personal information.

2. Eligibility

By using the Platform, you represent and warrant that:

  • You are at least 20 years of age. The Platform is strictly for adults, and we do not permit users under 20 under any circumstances.
  • You have the legal capacity and authority to enter into a binding contract under applicable Indian law.
  • You are not currently located in, under the control of, or a national or resident of any country to which India has embargoed goods or services.
  • You have not been previously suspended or removed from the Platform for violating these Terms or our community standards.
  • You are using the Platform of your own free will, for personal, non-commercial purposes.

We reserve the right to request proof of age at any time and to suspend or terminate accounts that cannot verify the user's age. Any use of the Platform by a minor is unauthorized and constitutes a violation of these Terms.

3. Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to:

  • Provide Accurate Information: You must provide truthful, accurate, current, and complete information during registration and keep your profile information updated. Knowingly providing false information is a breach of these Terms.
  • Maintain One Account: Each individual is permitted to maintain only one personal account. Creating multiple accounts, or creating accounts on behalf of others without authorization, is prohibited.
  • Protect Your Credentials: You are responsible for maintaining the confidentiality of your login credentials (email and password). You must notify us immediately of any unauthorized use of your account or any other breach of security.
  • Account Security: You should use a strong, unique password for your account. We are not liable for any loss or damage arising from your failure to protect your login credentials.

We reserve the right to reject any registration, suspend accounts, or require additional verification at our sole discretion. Accounts that remain inactive for an extended period may be deactivated after reasonable notice.

4. User Conduct and Behavior

The Platform is built on a foundation of mutual respect, honesty, and safety. As a user, you agree to interact with other members respectfully and to adhere to the following standards of conduct. You agree not to:

  • Harass or Abuse: Engage in harassment, bullying, intimidation, stalking, threats, or any form of abusive behavior toward other users. This includes sending unwanted, offensive, or persistent messages after being asked to stop.
  • Discriminate: Use hate speech or engage in discrimination based on race, ethnicity, religion, caste, gender, sexual orientation, disability, age, or any other protected characteristic.
  • Impersonate: Impersonate any person or entity, misrepresent your identity or affiliation, or create fake profiles. Catfishing and using others' photos without consent are strictly prohibited.
  • Spam or Solicit: Send unsolicited commercial messages, spam, chain letters, or pyramid schemes. Use the Platform for advertising, solicitation of business, or promoting external products or services without authorization.
  • Share Inappropriate Content: Post, upload, or share content that is obscene, pornographic, sexually explicit, violent, graphically disturbing, defamatory, or otherwise objectionable.
  • Engage in Illegal Activity: Use the Platform for any unlawful purpose or in furtherance of illegal activities, including but not limited to fraud, human trafficking, prostitution, or the exchange of illegal substances.
  • Collect User Data: Collect, harvest, or store personal data about other users without their explicit consent, or use automated means (bots, scrapers, spiders) to access or extract data from the Platform.
  • Interfere with the Platform: Attempt to disrupt, degrade, or compromise the Platform's functionality, security, or integrity through hacking, malware, denial-of-service attacks, or other malicious means.
  • Circumvent Restrictions: Attempt to bypass any security features, access controls, or usage limits we have implemented on the Platform.

Violation of any of these conduct standards may result in immediate suspension or termination of your account, removal of your content, and, where appropriate, referral to law enforcement authorities.

5. Community Rules

In addition to the general conduct standards, our community operates under the following specific rules designed to ensure a safe and positive environment for all members:

  • No Explicit Content: Profile photos and publicly visible content must not contain nudity, sexually explicit material, or graphic imagery. This applies to all areas of the Platform visible to other users.
  • No Solicitation: The Platform is not to be used for commercial sex work, escort services, or any form of paid sexual activity. Any profile or message indicating solicitation will be removed, and the account will be terminated.
  • No Hate Speech: Content that promotes violence, hatred, or discrimination against individuals or groups based on protected characteristics is not tolerated. This includes slurs, stereotypes, and language intended to demean or dehumanize.
  • No Fake Profiles: Every profile must represent a real, individual person. Using stock photos, AI-generated images, photos of other people without consent, or creating entirely fictitious personas is prohibited.
  • Respect Boundaries: If another user indicates they are not interested, asks you to stop messaging them, or blocks you, you must respect that decision. Continued attempts to contact someone who has blocked or rejected you constitute harassment.
  • Honest Representation: Use recent, accurate photos of yourself. Do not use heavily manipulated, filtered, or misleading images that do not reasonably represent your current appearance. Be honest in your profile information and when communicating with others.

Enforcement of community rules is at our sole discretion. We may, but are not obligated to, monitor user content and behavior. We encourage users to report any violations they encounter using the reporting tools available on the Platform.

6. Content You Share

The Platform allows you to create a profile, upload photos, send messages, and share other content ("User Content"). With respect to your User Content:

  • You Own Your Content: You retain all ownership rights to the User Content you create and share on the Platform. We do not claim ownership over your photos, profile information, or messages.
  • License to the Platform: By posting User Content on the Platform, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and modify your User Content solely for the purpose of operating, providing, improving, and promoting the Platform. This license ends when you delete your User Content or your account, except to the extent that your content has been shared with other users and they have not deleted it.
  • Content Responsibility: You are solely responsible for the User Content you share. You represent and warrant that you own or have the necessary rights to the content you post, and that your content does not infringe the rights of any third party.
  • Content Removal: We reserve the right to remove, edit, or restrict access to any User Content that we determine, in our sole discretion, violates these Terms, our community rules, or applicable law. We may do so without prior notice, though we will make reasonable efforts to notify you of the action taken.

7. Account Responsibility

You are fully responsible for all activities that occur under your account, whether or not authorized by you. This includes:

  • All content posted, messages sent, and interactions conducted through your account.
  • Any consequences, damages, or liabilities that result from the use of your account.
  • Ensuring that your use of the Platform complies with all applicable local, state, national, and international laws and regulations.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with these account security obligations.

You may not transfer, assign, or sell your account or any associated rights to another person. Accounts are personal and non-transferable.

8. Intellectual Property

All content, features, and functionality on the Platform that is not User Content — including but not limited to the design, layout, text, graphics, logos, icons, images, audio, video, software, code, algorithms, and the selection and organization thereof — is the exclusive property of One Night Stand India and is protected by Indian and international copyright, trademark, and other intellectual property laws.

  • Brand and Trademarks: The names "One Night Stand India," our logo, and all related names, domain names, product names, and service names are trademarks or registered trademarks of the Company. You may not use these marks without our prior written permission.
  • Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use, subject to these Terms. This license does not include any right to copy, modify, distribute, sell, or create derivative works from the Platform or its content.
  • User Content Rights: You retain all rights to your User Content, subject to the license you grant us under Section 6.
  • Feedback: If you provide us with any feedback, suggestions, or ideas regarding the Platform ("Feedback"), you agree that we may use such Feedback without restriction, compensation, or obligation to you.

9. Third-Party Links and Services

The Platform may contain links to third-party websites, applications, or services that are not owned, operated, or controlled by One Night Stand India. These links are provided for your convenience and reference only. We do not endorse, and are not responsible for, the content, accuracy, privacy practices, or any other aspect of these third-party services.

If you choose to access any third-party site or service linked from our Platform, you do so at your own risk. You should review the applicable terms and privacy policies of any third-party service before using it. We are not liable for any loss or damage that may arise from your dealings with third parties.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We make no guarantees regarding:

  • The accuracy, completeness, reliability, or timeliness of any content, profiles, or information available through the Platform.
  • The quality, character, or intentions of any user you may meet through the Platform.
  • The outcome of any interactions, dates, or relationships that may result from using the Platform.
  • The uninterrupted, error-free, or secure operation of the Platform at all times.
  • The compatibility or safety of meeting any individual you encounter through the Platform.

In no event shall One Night Stand India, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Platform, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.

Notwithstanding anything to the contrary in these Terms, our total cumulative liability to you for any claims arising from or related to your use of the Platform shall not exceed the amount you have paid to us, if any, in the twelve months immediately preceding the event giving rise to the claim, or INR 5,000 (whichever is greater).

You acknowledge that we are a platform connecting adults for casual dating and that we do not conduct background checks on users. You are responsible for taking appropriate safety precautions when meeting anyone from the Platform in person. We strongly encourage you to follow the safety guidance in these Terms.

11. Termination

We may suspend, deactivate, or terminate your account and access to the Platform, with or without prior notice, for any of the following reasons:

  • Violation of these Terms, our community rules, or applicable law.
  • Conduct that we determine, in our sole discretion, to be harmful to other users, the Platform, or our business interests.
  • Fraudulent, abusive, or illegal activity associated with your account.
  • Failure to verify your age or identity when requested.
  • Extended account inactivity, after reasonable notice has been provided.
  • At your request, by deleting your account through your account settings.

Upon termination:

  • Your right to access and use the Platform ceases immediately.
  • We may retain certain information about your account as required by law or for legitimate business purposes, in accordance with our Privacy Policy.
  • Provisions of these Terms that by their nature should survive termination (including Sections 6, 8, 10, 12, and 14) will continue to apply.
  • We reserve the right to refuse service to anyone who has had an account previously terminated for violations.

12. Dispute Resolution

We value our relationship with our users and aim to resolve disputes amicably and efficiently. The following provisions govern how disputes between you and One Night Stand India will be handled:

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes arising from these Terms or your use of the Platform.
  • Informal Resolution: Before initiating any formal legal proceedings, you agree to first contact us and attempt to resolve the dispute through informal negotiation. Both parties shall make good-faith efforts to reach a mutually satisfactory resolution within 30 days of the initial notification of the dispute.
  • Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Mumbai by a single arbitrator mutually agreed upon by both parties. The language of the arbitration shall be English.
  • Class Action Waiver: To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to Terms

We may update or modify these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will provide notice through one or more of the following methods:

  • Posting the updated Terms on this page with a revised "Last updated" date.
  • Sending an email notification to the address associated with your account.
  • Displaying a prominent notice on the Platform or requesting your acknowledgment when you next log in.

Material changes will become effective 30 days after we provide notice, unless you accept the updated Terms earlier by continuing to use the Platform. For non-material changes (such as clarifications or typographical corrections), the updated Terms are effective immediately upon posting.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Platform and delete your account. We encourage you to review these Terms periodically.
